Welcome to The Becoming Continuum.
These Terms of Service ("Terms") govern your access to and use of The Becoming Continuum website, platform, and related services (collectively, the "Platform").
The Becoming Continuum is a technology and marketplace platform that facilitates connections between individuals seeking coaching and independent coaches. The Becoming Continuum does not itself provide coaching services.
By accessing or using the Platform, creating an account, or using any services provided through the Platform, you agree to these Terms. If you do not agree to these Terms, please do not use the Platform.
1. Eligibility
The Becoming Continuum is currently available only to individuals located in the United States.
You must be at least 18 years old to create an account or use the Platform.
By using the Platform, you represent that:
- You are at least 18 years old;
- You are located in the United States;
- The information you provide is accurate and current; and
- You agree to comply with these Terms and applicable law.
The Becoming Continuum may expand to additional countries or regions in the future.
2. What The Becoming Continuum Does
The Becoming Continuum provides technology and marketplace services that allow Clients and independent Coaches to find one another and communicate.
The Platform may provide tools that allow users to:
- Create accounts and profiles;
- Submit or respond to coaching requests;
- Review profiles and proposals;
- Communicate with other users;
- Schedule services;
- Process payments;
- Submit reviews; and
- Manage other aspects of their participation on the Platform.
The Becoming Continuum is not a coaching provider.
The Becoming Continuum does not provide coaching, counseling, therapy, medical care, psychological services, or other professional services through the Platform.
The Becoming Continuum's role is to provide and operate the technology and marketplace through which users may connect.
3. Independent Coaches
All Coaches using the Platform are independent service providers.
Coaches are not employees, agents, representatives, partners, joint venturers, or contractors of The Becoming Continuum solely because they use the Platform.
The Becoming Continuum does not:
- Employ Coaches;
- Supervise Coaches;
- Direct how Coaches provide coaching;
- Determine the substance of coaching sessions;
- Establish the professional relationship between a Client and Coach;
- Guarantee a Coach's qualifications or results;
- Guarantee the availability of any Coach; or
- Guarantee that a particular Coach will be appropriate for a particular Client.
Each Coach is solely responsible for the coaching services they provide.
4. Client and Coach Relationship
Any coaching relationship established through the Platform is solely between the Client and the Coach.
The Becoming Continuum is not a party to the coaching relationship.
Clients are solely responsible for deciding whether to engage a Coach and for evaluating whether a Coach is appropriate for their needs.
Coaches are solely responsible for the services they provide to Clients.
Any agreement concerning coaching services, including the scope of services, rates, scheduling, cancellation policies, professional obligations, and other terms, is between the Client and Coach.
5. Coaching Services
The Becoming Continuum does not provide:
- Coaching;
- Therapy;
- Psychotherapy;
- Medical services;
- Mental-health treatment;
- Diagnosis;
- Legal services;
- Financial advice; or
- Emergency services.
Coaching provided by an independent Coach through the Platform is not a service provided by The Becoming Continuum.
Coaching should not be used as a substitute for professional medical, psychological, psychiatric, legal, financial, or other professional services when those services are appropriate.
If you are experiencing an emergency or believe you or another person is in immediate danger, contact appropriate emergency services or a qualified professional.
Coaches are responsible for staying within the scope of services they are qualified and legally permitted to provide.
6. Coach Responsibilities
Coaches are solely responsible for:
- The accuracy of their profiles;
- Their qualifications and credentials;
- The services they offer;
- Their coaching methods;
- Their communications with Clients;
- Their conduct toward Clients;
- Their compliance with applicable laws and professional obligations;
- Maintaining any licenses or certifications they represent themselves as holding; and
- The safety and quality of the coaching services they provide.
A Coach may not represent themselves as an employee, representative, or agent of The Becoming Continuum.
7. Client Responsibilities
Clients are responsible for:
- Providing accurate information;
- Exercising reasonable judgment when selecting a Coach;
- Evaluating whether a Coach's services are appropriate for their needs;
- Following applicable agreements with their Coach; and
- Communicating honestly and respectfully with Coaches.
The Becoming Continuum does not guarantee that any particular Coach will be suitable for a Client.
8. Coaching Requests and Proposals
Clients may submit requests describing the type of coaching support they are seeking.
Coaches may respond to Client requests with proposals describing their experience, approach, availability, rates, and other information.
The Becoming Continuum does not guarantee that:
- A Client will receive a proposal;
- A Coach will receive a Client;
- A Client will select a Coach;
- A Coach will be selected;
- A Client and Coach will be a suitable match; or
- A coaching relationship will produce a particular result.
The decision to enter into a coaching relationship is made solely by the Client and Coach.
9. User Conduct
Users are responsible for their own conduct on and through the Platform.
You may not use the Platform to:
- Violate applicable law;
- Harass, threaten, stalk, abuse, or exploit another person;
- Engage in discrimination or hateful conduct;
- Commit fraud;
- Impersonate another person;
- Misrepresent professional qualifications;
- Provide services you are not legally permitted to provide;
- Access another user's account without authorization;
- Access information you are not authorized to access;
- Introduce malicious software;
- Interfere with Platform security;
- Scrape or collect Platform information without authorization;
- Infringe another person's intellectual-property rights; or
- Engage in conduct that violates these Terms.
10. Payments and Fees
Certain Platform services may require payment.
Prices, membership fees, coaching fees, subscriptions, transaction fees, and other applicable charges will be clearly disclosed before payment is completed.
The Becoming Continuum may use third-party payment processors to facilitate transactions.
The Becoming Continuum is not responsible for disputes between Clients and Coaches regarding coaching fees or coaching services, except to the extent a dispute specifically concerns a payment-processing service provided by The Becoming Continuum.
11. Coach Memberships
The Becoming Continuum may offer paid memberships or subscriptions to Coaches.
The applicable membership price, billing frequency, renewal date, and other applicable terms will be clearly disclosed before a Coach completes enrollment.
Unless otherwise stated, Coach memberships automatically renew at the end of each billing period until canceled.
Membership provides access to the applicable Platform features during the paid membership period.
Membership does not guarantee clients, proposals, bookings, revenue, income, or any particular business outcome.
Cancellation
Coaches may cancel their membership at any time through the cancellation method provided in their account or by contacting:

A cancellation will prevent the membership from automatically renewing for the next billing period.
Unless otherwise required by law or expressly stated at the time of purchase, canceling a membership does not provide a refund for the current billing period.
A Coach who cancels will generally retain access to applicable membership features through the end of the period that has already been paid for.
For example, if a Coach is billed on the 15th of each month and cancels on the 20th, the membership will remain active through the end of the current paid billing period and will not renew on the next billing date.
The Becoming Continuum will provide reasonable confirmation of a completed cancellation.
Renewal Notices
Where required by applicable law, The Becoming Continuum will provide required notices concerning recurring charges, renewal terms, price changes, or other material changes to a membership.
Coaches are responsible for keeping their account and billing information current.
Price Changes
If the price of a Coach membership changes, The Becoming Continuum will provide notice of the change before the new price is charged and will provide any cancellation rights required by applicable law.
Refunds
Membership fees already charged are generally non-refundable unless:
- A refund is expressly offered;
- The Becoming Continuum determines that a refund is appropriate; or
- A refund is required by applicable law.
Nothing in this section limits any refund or cancellation rights that cannot legally be waived.
12. Coaching Cancellations and Refunds
Cancellation, rescheduling, and refund policies for coaching services may vary by Coach.
Coaches are responsible for clearly communicating their applicable policies to Clients before coaching services are purchased or scheduled.
The Becoming Continuum is not responsible for disputes concerning a Coach's cancellation, refund, rescheduling, or coaching policies, except where the dispute specifically concerns a service provided directly by The Becoming Continuum.
Nothing in these Terms limits rights or remedies that cannot legally be waived.
13. Reviews and User Content
Users may submit reviews, ratings, profiles, proposals, messages, comments, and other content.
Users are solely responsible for content they submit.
Reviews must reflect genuine experiences.
Users may not create fake reviews, purchase reviews, manipulate ratings, or submit knowingly false or misleading information.
By submitting User Content, you grant The Becoming Continuum permission to host, display, reproduce, and use that content as reasonably necessary to operate, maintain, and improve the Platform.
You retain ownership of content that you own.
14. Privacy
Your use of the Platform is also governed by our Privacy Policy.
The Privacy Policy explains how The Becoming Continuum collects, uses, stores, and protects personal information.
Users should exercise care when sharing personal information with other users.
15. Communications Between Users
The Platform may provide messaging and communication tools between Clients and Coaches.
Communications through the Platform are communications between users.
The Becoming Continuum is not responsible for statements, representations, advice, services, or conduct communicated by one user to another.
Users are responsible for exercising appropriate judgment when communicating with other users.
16. Assumption of Risk
You acknowledge that interacting with other users through an online marketplace involves inherent risks.
These risks may include, without limitation:
- Misrepresentation by another user;
- Inaccurate information;
- Disagreements between users;
- Unprofessional conduct;
- Emotional distress;
- Physical injury;
- Property damage;
- Financial loss;
- Privacy risks; and
- Other harm resulting from interactions with another user.
You voluntarily assume the risks associated with interacting with other users through the Platform to the maximum extent permitted by law.
You are responsible for making your own decisions regarding whether, when, where, and how to interact with another user.
17. Release of Claims Relating to Other Users
To the maximum extent permitted by applicable law, you release and agree not to hold The Becoming Continuum responsible for claims, demands, damages, losses, liabilities, costs, or expenses arising out of or relating to:
- Your interactions with another user;
- Coaching services provided by a Coach;
- Conduct of a Coach or Client;
- Statements or representations made by another user;
- Injuries allegedly caused by another user;
- Property damage caused by another user;
- Emotional or psychological harm allegedly resulting from interactions with another user;
- Disputes between users;
- The qualifications, credentials, or conduct of a Coach;
- The quality, safety, legality, or suitability of coaching services provided by a Coach; or
- Any other act or omission of another user.
This release applies to the maximum extent permitted by applicable law.
You acknowledge that The Becoming Continuum is a platform provider and is not the provider of the underlying coaching services.
Nothing in these Terms releases or limits liability to the extent such liability cannot lawfully be released or limited.
18. No Responsibility for User Conduct
The Becoming Continuum does not control and cannot guarantee the conduct of users.
We do not guarantee that users will:
- Accurately represent themselves;
- Possess the qualifications they claim;
- Behave professionally;
- Follow agreements with other users;
- Provide safe services;
- Comply with applicable laws; or
- Act appropriately in every situation.
You are responsible for your own interactions with other users.
If you believe another user has violated these Terms, you may report the conduct to The Becoming Continuum.
19. Intellectual Property
The Becoming Continuum and its content, branding, logos, graphics, text, design, software, and other materials are owned by or licensed to The Becoming Continuum and are protected by applicable law.
You may not copy, reproduce, modify, distribute, sell, license, reverse engineer, or create derivative works from Platform materials without authorization.
20. Third-Party Services
The Platform may use third-party services, including payment processors, scheduling services, analytics providers, communication services, and other technology providers.
Your use of third-party services may be subject to their own terms and privacy policies.
The Becoming Continuum is not responsible for the independent practices or availability of third-party services.
21. No Guarantee of Results
The Becoming Continuum does not guarantee any particular outcome from using the Platform or participating in coaching.
The Platform does not guarantee that:
- A Client will find a Coach;
- A Coach will obtain Clients;
- A Client and Coach will be a successful match;
- Coaching will achieve a particular result;
- A Coach will remain available; or
- The Platform will always be available.
22. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Platform is provided on an "as is" and "as available" basis.
The Becoming Continuum does not warrant that the Platform will always be available, secure, accurate, or error-free.
The Becoming Continuum does not warrant the qualifications, conduct, services, representations, or results of any user.
23. Limitation of Liability
To the maximum extent permitted by applicable law, The Becoming Continuum and its owners, employees, contractors, affiliates, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to:
- Your use of the Platform;
- Your inability to use the Platform;
- Your interactions with another user;
- Coaching services provided by a Coach;
- Conduct of another user;
- Injuries or damages allegedly caused by another user;
- Statements or representations made by another user;
- Disputes between users; or
- Any transaction or relationship between users.
To the maximum extent permitted by applicable law, The Becoming Continuum's total liability arising from your use of the Platform will be limited to the amount you paid directly to The Becoming Continuum for Platform services during the twelve months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
24. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless The Becoming Continuum and its owners, employees, contractors, affiliates, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from:
- Your violation of these Terms;
- Your misuse of the Platform;
- Your interactions with another user;
- Your User Content;
- Your violation of another person's rights; or
- Your unlawful or negligent conduct.
25. Account Suspension or Termination
The Becoming Continuum may suspend or terminate accounts when reasonably necessary, including when a user violates these Terms, engages in fraudulent or abusive conduct, creates a security or safety risk, or uses the Platform unlawfully.
We may also remove content or restrict access to Platform features when reasonably necessary to protect users or the Platform.
26. Platform Availability
We may modify, update, suspend, or discontinue any portion of the Platform.
We may temporarily suspend access for maintenance, security updates, improvements, or other operational reasons.
We do not guarantee uninterrupted or error-free availability.
27. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles.
Any dispute that cannot be resolved informally will be handled in accordance with applicable law in a court of appropriate jurisdiction.
Nothing in this section limits any rights or remedies that cannot legally be waived.
28. Changes to These Terms
We may update these Terms from time to time.
When material changes are made, we may provide notice through the Platform or another appropriate method.
The updated Terms become effective on the date stated in the updated Terms.
Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms to the extent permitted by law.
29. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by law.
30. Entire Agreement
These Terms and our Privacy Policy constitute the agreement between you and The Becoming Continuum regarding your use of the Platform, except where additional terms apply to a particular service.
